Please read these terms carefully. By using BakkieHi's services, you agree to be bound by these terms and conditions.

1. Introduction & Agreement
These Terms of Use ("Terms") govern your access or use, from within the Republic of South Africa and its territories and possessions, of the applications, websites, content, products, and Services (the "Services") provided by BakkieHi Tech Pty Ltd ("BakkieHi", "We", "Us" or "Our").
This Agreement is a legally binding agreement made between you, the Driver or User ("You" or "Your") and BakkieHi Tech Pty Ltd. By accessing or using the Services, you confirm your agreement to be bound by these Terms. If you do not agree, you may not access or use the Services.
BakkieHi may amend these Terms from time to time. Amendments will be effective upon posting. Your continued use of the Services confirms your consent to be bound by the updated Terms.
2. The Services
The Services comprise a mobile and web application that enables Users to arrange and schedule transportation, logistics, moving and/or delivery services with third-party Drivers. Services include:
- On-Demand Delivery — same-day or scheduled bakkie and truck hire across South Africa
- Parcel Delivery — local, inter-provincial and nationwide parcel transport
- Bakkie Rentals — self-drive vehicle hire for flexible moving needs
Unless otherwise agreed in writing with BakkieHi, Services are made available solely for your personal, non-commercial use. Services may be made available under various brands or request options including "BakkieHi", "BakkieHiBLACK", and the logistics request product currently referred to as "BakkieHiB2B".
YOU ACKNOWLEDGE THAT YOUR ABILITY TO OBTAIN TRANSPORTATION, LOGISTICS AND/OR DELIVERY SERVICES THROUGH THE USE OF THE SERVICES DOES NOT ESTABLISH BAKKIEHI AS A PROVIDER OF TRANSPORTATION, LOGISTICS, MOVER OR DELIVERY SERVICES OR AS A TRANSPORTATION CARRIER.
2.1 Third-Party Providers
Services may be provided by independent third-party Drivers. BakkieHi does not control the actions or conduct of these Drivers. The Services may also be made available in connection with third-party services and content (including advertising) that BakkieHi does not control. Different terms of use and privacy policies may apply to your use of such third-party services.
2.2 Licence and Restrictions
Subject to compliance with these Terms, BakkieHi grants you a limited, non-exclusive, non-sub-licensable, revocable, non-transferable licence to access and use the application on your personal device solely in connection with your use of the Services. You may not:
- Remove any copyright, trademark or proprietary notices from the Services
- Reproduce, modify, prepare derivative works, distribute, license, lease, sell, resell, transfer, publicly display, broadcast or otherwise exploit the Services except as expressly permitted
- Decompile, reverse-engineer or disassemble the Services except as permitted by applicable law
- Link to, mirror or frame any portion of the Services
- Run programs or scripts to scrape, index, survey, or data-mine the Services
- Attempt to gain unauthorised access to the Services or related systems
2.3 Ownership and Intellectual Property
The Services and all rights therein are and shall remain BakkieHi's property or the property of BakkieHi's licensors. All intellectual property rights — including database rights, copyright, design rights, and trademarks — are owned by BakkieHi absolutely and in their entirety.
By providing any feedback, suggestions, or User Content to BakkieHi, you grant BakkieHi a worldwide, perpetual, irrevocable, transferable, royalty-free licence to use, copy, modify, distribute, and otherwise exploit such content. You represent that you own or have the necessary rights to all content you submit.
3. User Accounts & Requirements
To use most aspects of the Services, you must register for and maintain an active account. Account registration requires you to be at least 18 years of age, or the age of legal majority in your jurisdiction, and to provide accurate personal information including your name, address, mobile phone number, and a valid payment method supported by BakkieHi.
- You are responsible for all activity that occurs under your account
- You must maintain the security and secrecy of your username and password at all times
- Unless otherwise permitted by BakkieHi in writing, you may only possess one account
- You may not allow persons under the age of 18 to receive Services unless accompanied by you
- You agree to maintain accurate, complete, and up-to-date information in your account; failure to do so may result in inability to access the Services
3.1 Prohibited Conduct
You agree not to:
- Impersonate any person or entity
- Stalk, threaten or harass any person
- Carry any weapons
- Violate any laws, ordinances or regulations
- Interfere with or disrupt the BakkieHi application(s)
- Transmit material containing software viruses or harmful code
- Transport unlawful or hazardous materials, including firearms, explosives, or hazardous chemicals
- Cause nuisance, annoyance, inconvenience or property damage to a Third Party Provider or any other party
- Transfer or sell your BakkieHi account or ID to any other party
- Provide content that is defamatory, hateful, violent, obscene, pornographic, unlawful, or otherwise offensive
BakkieHi reserves the right to investigate and terminate your participation if you have misused the Services or operated in a manner regarded as inappropriate, unlawful, or illegal.
3.2 Identity Verification
You may be asked to provide proof of identity to access or use the Services. You may be denied access if you refuse to provide such verification.
3.3 Communications
By becoming a User and/or Driver, you consent to receiving email and SMS notifications from BakkieHi, including booking confirmations, marketing messages and platform updates. You may opt out of marketing messages at any time by emailing help@bakkiehi.co.za.
4. Driver Qualifications & Warranties
BakkieHi's most important job is ensuring that Drivers in the network have been vetted and qualified. Each Driver must pass a point qualification including a background check, driving record review, insurance verification, and vehicle suitability assessment. BakkieHi does not guarantee that the information provided by Drivers is correct.
By using the Services as a Driver, you warrant that:
- You are 21 years of age or older
- You have the ability to lift and carry items
- You possess a valid and current South African driver's licence
- You own, or have the legal right to operate, the vehicle
- The vehicle is in good condition and meets all applicable standards
- You maintain a valid insurance policy in the name of the Driver or the registered owner of the vehicle
- You will obey and follow all local and national laws related to transportation, logistics, deliveries and moving
- You are an independent contractor and not an employee of BakkieHi or BakkieHi Tech Pty Ltd
4.1 Inspection & Damage Claims
At the original location, the Driver will inspect and photograph all items to be moved to record any pre-existing imperfections. At the destination, the Driver will again inspect and photograph all items to record their condition.
If the User claims their items were damaged, the Driver will note, photograph and describe the alleged damage and immediately notify BakkieHi.
4.2 Insurance & Accidents
The Driver and the Driver's Insurance Policy shall be solely responsible for coverage for any and all claims or incidents that occur during transporting, moving and/or relocating the User's items. In the event of any claim or motor vehicle accident, the Driver is solely responsible for reporting the incident in compliance with applicable statutory or motor vehicle requirements.
4.3 Conduct & Misrepresentation
The Driver shall not make false or misrepresentations of BakkieHi, seek non-voluntary compensation from Users, or discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation.
4.4 Uniforms
All approved Drivers with vehicles are required to purchase BakkieHi-branded uniforms. This is mandatory — Drivers will not be able to accept trip requests unless the uniform has been purchased and verified on the platform.
5. Payments & Charges
Use of the Services may result in charges ("Charges") for the services or goods you receive. BakkieHi will receive and/or enable your payment of the applicable Charges. Charges are calculated by:
- Type and size of vehicle (bakkie or truck)
- Type of goods being transported
- Distance travelled (kilometres of the trip)
- Optional add-ons (Manpower, Goods Insurance, pre/post clean)
Charges are inclusive of applicable taxes where required by law and may include additional fees, tolls, and surcharges including a booking fee, municipal tolls and processing fees.
- All Charges and payments are enabled by BakkieHi using the preferred payment method designated in your account; you will receive a receipt by email
- If your primary payment method is expired or invalid, BakkieHi may use a secondary payment method on file
- Charges paid by you are final and non-refundable, unless otherwise determined by BakkieHi
- BakkieHi reserves the right to revise Charges at any time at its sole discretion
- Charges in certain geographical areas may increase substantially during times of high demand
5.1 Cancellation Fee
5.2 Repair, Cleaning or Lost-and-Found Fees
You shall be responsible for the cost of repair for damage to, or necessary cleaning of, vehicles and property resulting from use of the Services under your account in excess of normal "wear and tear". Where BakkieHi reasonably verifies a Repair or Cleaning request, BakkieHi reserves the right to facilitate payment for the reasonable cost using your designated payment method. Such amounts, as well as those pertaining to lost-and-found goods, are non-refundable.
5.3 Driver Payments
Drivers are paid Weekly, typically every Monday. BakkieHi processes all payments through a third-party payment processor. Driver amounts are net of administration fees and any amounts BakkieHi is required to withhold by law. Drivers may also request withdrawals at any time via the BakkieHi Driver App; instant withdrawals may include a service fee.
BakkieHi reserves the right to withhold or delay payment if there is a suspected attempt to defraud or abuse the platform or payment processor.
5.4 Tipping
Tipping is voluntary and not required. While you are free to provide additional payment as a gratuity to any Driver, you are under no obligation to do so.
6. Limitation of Liability
BakkieHi provides the Services on an "as is" basis without any warranty or condition, express, implied or statutory. In no event shall BakkieHi, its subsidiaries, officers, directors, employees, partners or suppliers be liable to you for any incidental, consequential, direct or indirect damages arising out of or in connection with BakkieHi's Services or this Agreement.
BakkieHi is not responsible for damage or loss to personal items being transported, personal injuries sustained by a Driver, or any offline conduct of any User of the Services.
7. Goods Insurance
Customers are strongly encouraged to opt in for Goods Insurance when booking a delivery. Insurance covers your goods in transit — from the moment they are collected by the Driver until they are delivered to the drop-off location — and ensures that you can claim for damage or loss that occurs during the move.
7.1 Optional cover tiers
For higher-value goods, you may add one of the following optional tiers during checkout:
- Tier 1 — Assets value (CVG) up to R 20 000 · premium R 2 600
- Tier 2 — Assets value (CVG) up to R 50 000 · premium R 6 980
- Tier 3 — Assets value (CVG) up to R 100 000 · premium R 25 000
For full house moves, comprehensive insurance is available — all items must be listed in the booking with their declared value.
7.2 Claims and exclusions
Claims are subject to the policy terms set out in this section and to the declared value of the goods at the time of booking. BakkieHi does not guarantee any claim for goods that were not insured. Pre-existing damage, items packed by the customer in a manner unfit for transport, hazardous goods, prohibited items, and consequential losses are excluded from cover.
To submit a claim, contact us at claims@bakkiehi.co.za within 48 hours of delivery, providing photographs of the damaged goods, the booking reference, and the declared value.
7.3. Condition Verification and Proof of Damage
7.3.1. Customers who elect to purchase the BakkieHi Goods Insurance option are required to take clear and complete photographs of all goods at the pickup location prior to loading. These photographs will serve as evidence that the goods were in good condition before transportation commenced.
7.3.2. In the event of alleged loss or damage, customers must also take clear photographs of the goods at the drop-off location immediately upon delivery and before use, assembly, unpacking, or relocation.
7.3.3. Failure to provide sufficient photographic evidence from both pickup and drop-off locations may result in the rejection or limitation of the insurance claim.
7.4. Proof of Ownership and Value of Goods
7.4.1. Any customer submitting a claim must provide reasonable proof of ownership and value of the goods being claimed.
7.4.2. Acceptable supporting documents include:
- Purchase invoices;
- Retail receipts;
- Proof of payment;
- Warranty certificates; or
- Any official documentation indicating ownership and purchase value.
7.4.3. Where no proof of purchase or ownership documentation exists, the customer may be required to submit a sworn affidavit certified at a South African Police Service (SAPS) station confirming ownership, estimated value, and circumstances of the claim.
7.4.4. Submission of an affidavit does not guarantee claim approval and BakkieHi reserves the right to request additional verification where reasonably necessary.
7.5. Settlement of Claims
7.5.1. Upon approval of a valid claim, BakkieHi reserves the sole discretion to determine the appropriate remedy.
7.5.2. Remedies may include:
- Repair of the damaged goods;
- Replacement of the damaged goods with an equivalent item of similar functionality, specification, and value (which may be of a different brand); or
- Monetary compensation where deemed appropriate by BakkieHi.
7.5.3. Replacement goods do not need to match the original brand, provided they are reasonably comparable in quality, functionality, and value.
7.5.4. BakkieHi shall not be liable for sentimental value, indirect losses, consequential damages, or loss of business arising from damaged or lost goods.
7.6. Claims Notification Period
7.6.1. Customers must submit any claim in writing together with all supporting evidence within 48 hours of delivery.
7.6.2. Claims submitted outside the prescribed period may not be considered.
7.7. Final Claim Determination
7.7.1. BakkieHi reserves the right to investigate all claims and make the final determination regarding claim approval, repair, replacement, or compensation.
8. Confidentiality
You agree not to use any technical, financial, strategic, tactical or other proprietary and confidential information relating to BakkieHi's business, operations and properties ("Confidential Information") disclosed to you for any purpose other than as contemplated in these Terms.
You shall not disclose or permit disclosure of any Confidential Information to third parties and shall take all reasonable measures to protect its secrecy. You will not have liability with regard to information that:
- Was in the public domain at the time of disclosure, or has entered the public domain through no fault of yours
- Was known to you, without restriction, at the time of disclosure (as demonstrated by files in existence at the time)
- Is disclosed with the prior written approval of BakkieHi
- Is disclosed pursuant to the order or requirement of a court, administrative agency, or other governmental body — provided that you give BakkieHi prompt notice so it may seek a protective order
You also agree not to post any information about BakkieHi's operations, services or applications on social media or other public domains in a manner that would tarnish BakkieHi's name, brands, partners, directors, employees or third parties. Service-related issues should be raised directly with BakkieHi via help@bakkiehi.co.za.
9. Term & Termination
This Agreement is effective upon use of the Services for new Users and upon the posting dates of any subsequent amendments for current Users. Either party may terminate participation at any time, for any reason, upon written or email notice.
BakkieHi may immediately terminate or suspend your account for any reason, including but not limited to:
- Unsafe or illegal operation of your vehicle
- Unsafe, threatening, or unprofessional interactions with Users or the public
- Misrepresentation of BakkieHi or its brands
- Failure to adhere to the Driver Representations and Warranties
- Violation of any term of this Agreement
Upon termination, BakkieHi will remove your information from its servers, though it may retain archived copies as required by law or for legitimate business purposes. BakkieHi maintains sole discretion to bar your future use of the Services.
9.1 Account Deactivation
Your account may be deactivated for various reasons or for further investigation. These decisions are taken after a careful consideration of all available information and the conditions outlined in this Agreement.
1. Vehicle Allocation
The vehicle selected during the booking process serves as a preferred vehicle category only and does not guarantee the exact make, model, year, colour, or specification of the vehicle provided. BakkieHi reserves the right to allocate an alternative vehicle that meets or exceeds your requested category, operational requirements, and agreed rental budget.
2. Rental Fulfilment Through Partners and BakkieHi Service Providers
To fulfil your rental request and subject to vehicle availability, BakkieHi reserves the right to provide the rental vehicle through:
- an approved third-party vehicle rental provider; or
- BakkieHi's network of approved Bakkie owners and service providers.
Where a third-party rental provider is used, the client agrees to comply with that provider's rental agreement, policies, insurance requirements, and Terms and Conditions in addition to these BakkieHi Terms and Conditions. The client acknowledges that the assigned vehicle may originate from either BakkieHi's internal service provider network or an authorised rental partner.
3. Driver Eligibility
The client confirms that all drivers who will operate the rented vehicle:
- hold a valid driver's licence appropriate for the vehicle class;
- meet any minimum age requirements imposed by BakkieHi or the rental provider;
- are legally permitted to operate a motor vehicle within the Republic of South Africa.
Only authorised drivers approved during the booking process may operate the rented vehicle unless otherwise authorised in writing.
4. Refundable Security Deposit
All rentals are subject to a refundable security deposit. The deposit amount will be determined following BakkieHi's assessment of:
- the requested vehicle;
- rental duration;
- intended vehicle usage;
- supporting documentation;
- driver verification; and
- any other risk factors considered relevant by BakkieHi.
BakkieHi reserves the right to request additional documentation before confirming the rental.
5. Security Deposit Refund
Where applicable, the refundable security deposit will be processed within seven (7) business days after:
- the vehicle has been successfully returned;
- all inspections and post-rental assessments have been completed;
- the client has completed and submitted the required Deposit Refund Form; and
- BakkieHi has concluded its due diligence process.
The client agrees to cooperate fully with BakkieHi during this process and to promptly provide any additional information, documentation, or evidence reasonably required. Failure to do so may result in delays or temporary withholding of the deposit.
The refunded amount may be less than the original deposit. BakkieHi may deduct costs including but not limited to:
- excess kilometres travelled;
- vehicle damage;
- excessive wear and tear;
- missing accessories or equipment;
- cleaning or restoration costs;
- fuel shortages upon return;
- traffic fines, toll fees, or penalties incurred during the rental period;
- administrative costs arising from breaches of these Terms and Conditions; and
- any other reasonable costs resulting from the client's use of the vehicle.
6. Intended Use of the Vehicle
The client must accurately disclose the intended use of the rented vehicle before the rental commences. BakkieHi reserves the right to decline, amend, or cancel any booking where:
- the intended use presents an unacceptable level of risk;
- false or misleading information has been provided; or
- the actual use differs materially from that declared during booking.
7. Prohibited Use
The rented vehicle may not be used for:
- any unlawful or criminal activity;
- racing, competitions, or speed testing;
- transporting hazardous or prohibited goods without approval;
- carrying loads that exceed the manufacturer's recommended capacity;
- subletting or hiring the vehicle to another person;
- driving outside authorised geographic areas where applicable; or
- any purpose not disclosed during the booking process.
8. Vehicle Return
The vehicle must be returned on the agreed date, time, and location. Late returns may result in additional rental charges, penalties, or extension fees. If the client anticipates a delay, they must notify BakkieHi immediately. Approval of a late return remains at BakkieHi's discretion.
9. Accidents, Theft and Breakdowns
The client must immediately notify BakkieHi of any accident, theft, damage, mechanical failure, or incident involving the rented vehicle. Where required by law, the client must report the incident to the South African Police Service and cooperate fully with BakkieHi, its insurers, and any appointed service providers throughout the claims process.
10. Insurance and Client Liability
Where insurance is provided, it shall be subject to the applicable insurer's policy terms, exclusions, and excess amounts. The client remains responsible for:
- any applicable insurance excess;
- losses arising from negligence or misuse;
- unauthorised use of the vehicle;
- breaches of these Terms and Conditions; and
- any uninsured losses recoverable by BakkieHi or the vehicle owner.
11. Right to Refuse or Cancel a Booking
BakkieHi reserves the right to refuse, suspend, or cancel any booking where:
- required documentation cannot be verified;
- the client fails the risk assessment process;
- a suitable vehicle is unavailable;
- payment obligations are not met; or
- the client breaches these Terms and Conditions.
12. Acceptance of Terms
By completing a BakkieHi Bakkie Rental booking, the client confirms that they have read, understood, and agree to these Terms and Conditions, together with any additional terms applicable to the assigned rental partner or authorised BakkieHi service provider.
1. Courier Service Providers
The BakkieHi Parcel Delivery Service is fulfilled through BakkieHi's approved third-party courier service providers. By selecting a courier service through the BakkieHi Platform, the client acknowledges and agrees that the requested delivery will be performed by an independent courier partner and not directly by BakkieHi.
The client further agrees that they shall also be bound by the applicable Terms and Conditions, policies, service standards, insurance provisions, prohibited items list, and operational requirements of the relevant third-party courier service provider.
2. Booking Information
The client is responsible for ensuring that all information provided during the booking process is complete and accurate, including but not limited to:
- Sender details;
- Recipient details;
- Collection and delivery addresses;
- Contact numbers;
- Parcel description;
- Parcel dimensions and weight; and
- Any special delivery instructions.
BakkieHi shall not be responsible for delays or failed deliveries resulting from inaccurate or incomplete information supplied by the client.
3. Parcel Contents
The client warrants that all information provided regarding the parcel contents is accurate and complete. The client must not tender any parcel containing illegal, dangerous, hazardous, prohibited, or restricted goods unless expressly permitted by the selected courier provider and all applicable laws. BakkieHi and its courier partners reserve the right to refuse collection or delivery of any parcel suspected to contain prohibited or undeclared items.
4. Delivery Timeframes
Estimated delivery times are provided for guidance only and may vary due to operational requirements, weather conditions, traffic, public holidays, customs procedures, or other circumstances beyond the reasonable control of BakkieHi or the courier partner. Delivery time estimates do not constitute guaranteed delivery commitments unless expressly stated by the selected courier provider.
5. Failed Collections and Deliveries
Where a collection or delivery cannot be completed due to circumstances attributable to the client or recipient — including incorrect addresses, recipient unavailability, refusal to accept delivery, or inaccurate contact information — additional collection, storage, or re-delivery charges may apply in accordance with the courier partner's applicable policies.
6. Loss or Damage
Any claims relating to loss, theft, damage, or delay of a parcel shall be assessed in accordance with the applicable policies and claims procedures of the selected courier service provider. Where required, the client agrees to provide all supporting documentation reasonably requested to facilitate the claims process.
7. BakkieHi's Role
BakkieHi operates as a technology platform that enables clients to access courier delivery services provided by independent third-party courier partners. While BakkieHi endeavours to work only with reputable courier providers, the client acknowledges that delivery services are performed by independent service providers, and BakkieHi's responsibilities are limited to facilitating the booking and related platform services.
8. Acceptance of Terms
By placing a Parcel Delivery booking through the BakkieHi Platform, the client confirms that they have read, understood, and agree to these Terms and Conditions together with the applicable Terms and Conditions of the selected third-party courier service provider.
